Akuru Type Font License Agreement

1. Licensing Overview

Every use of a font from Akuru Type is subject to the applicable license terms. Please read this agreement, including the definitions and technical usage provisions, before downloading, purchasing, installing, embedding or using any font.

Each font page on the Akuru Type website identifies its applicable license category:

• Free for All Use
• Free for Personal Use (Commercial License Required for Other Use)
• Commercial License

The applicable category determines whether the intended purpose of use is permitted. Desktop, Web-font and Application describe the technical ways in which the Font Software may be used.

Where a font-specific license, written agreement or product page specifies additional conditions, those conditions apply to that font and use. If there is a conflict, the specific written terms agreed with Akuru Type will take precedence to the extent of the conflict.

Downloading a free font does not mean that all uses are permitted. The permissions and restrictions associated with the relevant license category continue to apply.

2. License Categories

2.1 Free for All Use

Fonts marked Free for All Use may be used by individuals, businesses and Organisations, including for Commercial Use, without a license fee.

The permitted purpose may include personal, organisational and commercial activities, subject to the applicable technical usage provisions and any font-specific restrictions.

The Font Software must not be modified or altered unless the applicable font license expressly permits it.

2.2 Free for Personal Use (Commercial License Required for Other Use)

Fonts marked Free for Personal Use are free only for Personal Use. Every other use requires a purchased Commercial License or prior written permission from Akuru Type.

Permitted free use

You may use these fonts without charge for Personal Use as defined in Section 5, including:

• Personal creative projects.
• Personal websites and personal social media.
• Assignments submitted by a student for their own studies.

Use requiring a Commercial License

You must purchase a Commercial License before using these fonts for:

1. Organisational Use, including use by businesses, NGOs, non-profits, charities, associations, clubs, unions, political parties and other bodies, or by employees, members, volunteers or office-bearers acting on their behalf.
2. Political Use, including public or internal elections, party primaries, and campaigning for or against a candidate, party, slate or motion.
3. Commercial Use, including promoting a product, service or business, or any use that generates direct or indirect revenue.

These requirements apply even if the activity is unpaid, voluntary, non-profit or generates no revenue.

When in doubt: If you are unsure whether your intended use qualifies as Personal Use, contact Akuru Type before using the font. Do not proceed with the disputed use until Akuru Type confirms the permitted use in writing.

Download confirmation: By downloading a font marked Free for Personal Use, you confirm that you are downloading it for Personal Use only and will obtain the appropriate Commercial License before any other use. A person who downloads a font for Personal Use may not use it, or allow it to be used, for an Organisation or for Political Use without the required permission.

2.3 Commercial License

Premium fonts and fonts marked Free for Personal Use may be licensed for use beyond Personal Use by purchasing a Commercial License, subject to availability and the specific terms stated for the font.

A Commercial License may cover Commercial Use, Organisational Use and Political Use by individuals, businesses, offices and Organisations, including non-profit Organisations.

Examples include:

• Brand identities, lettermarks and logos.
• Marketing and promotional materials.
• Business and organisational communications.
• Materials for NGOs, non-profits and charities.
• Campaign and election materials.
• Other uses covered by the applicable license.

The scope of a Commercial License is determined by the license purchased and any font-specific conditions. It does not transfer copyright ownership or permit unauthorised redistribution of the Font Software.

Commercial Licenses are non-transferable unless expressly agreed otherwise in writing. The fonts may not be resold, sublicensed, reproduced or modified for distribution to a third party except where expressly authorised by the applicable license or by written permission from the relevant rights holder.

If a font has no Commercial License available, use beyond the permissions stated for that font is not permitted without Akuru Type's prior written consent.

2.4 Third-Party Platforms, Design Packs, AI Systems and Font Redistribution

Third-Party Platforms and Design Packs

Purchasing or obtaining a design, template, design pack or other digital asset from a third-party platform, marketplace, designer or service does not, by itself, grant a license to the underlying Akuru Type Font Software.

A license granted by Akuru Type is governed by the applicable license category, scope and permitted uses. A third party's purchase, subscription, distribution or use of a font does not automatically transfer or extend font usage rights to another person or entity.

No person may sell, distribute, share, sublicense or make Akuru Type Font Software available as a standalone file or as part of a design pack, template, application or other digital product unless such distribution or embedding is expressly authorised by the applicable license or by written permission from the relevant rights holder.

Where a font is embedded in an application or digital product, the applicable technical usage permissions and conditions must be satisfied. Permission to use an exported design or flattened graphic does not, by itself, grant permission to obtain, extract, install or redistribute the underlying Font Software.

Purchasing a Canva design, Canva template, design pack or similar product does not, by itself, establish that the buyer has obtained a license to the underlying font software. The rights of the buyer depend on the permissions applicable to the font, the relevant platform and the specific use.

Artificial Intelligence, Machine Learning and Font Derivatives

Unless expressly authorised by a separate written license or permission from Akuru Type or the relevant rights holder, no person or entity may use, upload, submit, provide, distribute or otherwise make Akuru Type Font Software available to any artificial intelligence (AI), machine learning or generative AI system, model, service or tool for the purpose of training, fine-tuning, testing, evaluating, developing, improving or validating that system or model.

This restriction includes, without limitation:

• Using Akuru Type Font Software, its glyphs, character designs, font files, outlines, metadata or other font-related data as training or reference material for developing, training, fine-tuning or improving an AI or machine learning model.
• Uploading or providing the Font Software to an AI tool or service to generate, recreate, imitate, analyse or learn from the font's distinctive letterforms or design characteristics.
• Using AI or automated tools to create, reproduce, adapt, modify, convert, reconstruct or generate a new font, typeface, font file or derivative work based on Akuru Type Font Software.
• Using the Font Software or its contents to create, assist in creating, or improve a competing or substantially similar font, typeface or lettering system through AI-assisted or automated processes.
• Circumventing technical protections or license restrictions to extract font data, glyph outlines or other protected elements for any of the above purposes.

These restrictions apply whether the AI system or tool is operated locally or through a third-party service, whether the activity is commercial or non-commercial, and whether the resulting model, font or output is distributed, sold, published or kept for private use.

A license to use a font for desktop, web, application, organisational, commercial or personal design purposes does not, by itself, include permission to use the Font Software for AI training, model development, font generation or the creation of derivative fonts. Such permission must be expressly granted in writing.

AI-Assisted Design and Ordinary Font Use

Using an AI tool to assist with an ordinary design, image, document or other permitted creative output in which a licensed Akuru Type font is used does not, by itself, constitute AI training or font derivation. However, the applicable license must still permit the underlying use, and the Font Software must not be supplied to or used by the AI system in a manner prohibited by this section.

Evidence and Enforcement

Akuru Type may request reasonable evidence of a font's source and the authorisation covering its use, including where a person relies on a third-party platform, purchase, subscription, AI service or distribution arrangement as the basis for using the Font Software.

Any unauthorised use under this section may constitute a breach of the applicable license and may result in suspended

3. License Types and Technical Usage

The applicable license category determines whether the intended purpose of use is permitted. The following provisions describe the technical methods of using the Font Software. All technical usage remains subject to the restrictions of the applicable category, the relevant font page and any written license terms.

3.1 Desktop License

The Desktop License permits the Font Software to be installed on desktop computers, laptops and workstations for use by the authorised licensee.

Permitted uses may include:

• Creating documents and printed publications.
• Producing newspapers, magazines, books and other printed materials.
• Creating static graphics for screens, including social media graphics.
• Preparing branding, marketing and communication materials.
• Other desktop-based uses permitted by the applicable license category.

The license does not permit the Font Software to be redistributed, shared with unauthorised users or made available for download by third parties.

Where a license is limited by the number of users, devices, locations or other conditions, those limits must be observed.

3.2 Web-font License

Using a font to render live text on a website, intranet or web-based application requires the applicable Web-font permissions. The following technical arrangements may be used where covered by the license obtained.

A. Web-font Self-hosting

The licensee hosts the Font Software on its own web servers.

The Font Software must be stored securely and served in connection with the licensed domain names. The licensee must take reasonable precautions to prevent unauthorised downloading, extraction or redistribution of the font files.

Third-party font hosting services may not be used under a self-hosted arrangement unless expressly authorised.

B. Web-font Hosted

The licensee uses an authorised Akuru Type web-font hosting partner.

The hosting partner may store and serve the fonts, optimise them for browser use and apply technical protections such as domain or server referrals, caching, pattern matching and font-file obfuscation.

The licensee must comply with the terms of the applicable hosting service and must not attempt to bypass its technical protections.

A Web-font License does not authorise the redistribution of the underlying Font Software or its use outside the licensed scope.

3.3 Application License

The Application License covers embedding the Font Software in an application or digital product for the permitted rendering of live text, where that use is covered by the applicable license.

Applications may include:

• Desktop software applications.
• Mobile applications that run natively on mobile operating systems.
• Web-based applications, subject to the relevant Web-font provisions.
• Console games and other software products that render live text.

The Font Software must be embedded in a secure digital format and implemented in a manner that permits the intended viewing and rendering of text without giving users unauthorised access to the underlying font files.

Unless expressly authorised by the applicable license, end users must not be able to download, extract, edit, alter, redistribute or otherwise access the Font Software as a reusable font file.

An Application License does not, by itself, grant permission to distribute the Font Software as a standalone product, include it in a font library or design pack, or permit users to extract the font from the application.

3.4 Applying the License Category to Technical Usage

The license category and technical usage provisions must be read together.

A license category establishes whether the intended purpose of use is permitted. Desktop, Web-font and Application provisions establish the technical conditions applicable to the method of use.

Accordingly:

1. A Free for All Use font may be used for permitted personal, organisational and commercial purposes, subject to the applicable technical and font-specific conditions.
2. A Free for Personal Use font may be used for Personal Use without charge. Use for an Organisation, Political Use or Commercial Use requires the appropriate Commercial License, regardless of whether the font is installed on a desktop, served on a website or embedded in an application.
3. A Commercial License permits the uses covered by the purchased license, subject to its stated scope and restrictions.

Possessing a license for one font does not grant rights to other fonts. A license for one purpose or deployment does not authorise uses outside its stated scope.

4. Ownership and Copyright

4.1 Copyright protection

Fonts and Font Software, including their original designs, glyphs, outlines and software code, may be protected by copyright and other applicable intellectual property rights under the laws of the Republic of Maldives, including the Copyright and Related Rights Act (Law No. 23/2010), as amended, where the relevant legal requirements are met.

Protection in other jurisdictions depends on the applicable laws and international arrangements.

4.2 Ownership remains with the rights holder

Copyright and other intellectual property rights in each font remain with its designer, publisher or other lawful rights holder (the Contributor), or with Akuru Type or Encreare Pvt Ltd where they own the relevant rights.

Downloading or purchasing a font grants only the permissions stated in the applicable license. It does not transfer ownership of the Font Software or its copyright.

4.3 Akuru Type's authority

Where authorised by the relevant Contributor or rights holder, Akuru Type may license the font and administer or enforce the applicable license terms within the scope of that authorisation.

Any enforcement action taken by Akuru Type on behalf of a Contributor is subject to the relevant rights, authorisation and applicable law.

4.4 Rights reserved

All rights not expressly granted by the applicable license remain reserved by the relevant rights holder.

4.5 Licensed use only

Use of a font outside the permissions granted by the applicable license may constitute a breach of this agreement and may also infringe intellectual property rights under applicable law.

5. Definitions

For the purposes of this agreement, the following terms have these meanings.

5.1 Personal Use

Use by an individual acting only in their private capacity for non-commercial purposes that do not generate direct or indirect revenue. Examples include personal creative projects, personal websites, personal social media and assignments submitted by a student for their own studies.

Personal Use does not include Organisational Use, Political Use or Commercial Use.

5.2 Organisation

Any company, business, office, NGO, non-profit, charity, trust, foundation, association, club, society, union, cooperative, political party, religious body, school, university, other institution, government body or group of persons, whether registered or unregistered and whether profit-making or not.

5.3 Organisational Use

Any use by, for or on behalf of an Organisation. Use by an employee, member, volunteer, office-bearer or other representative in connection with an Organisation's activities is considered use on its behalf.

5.4 Political Use

Any use by a person or Organisation for a political purpose, including:

• Any public or internal election or vote, including party primaries and elections within an association, union, club, council or other body.
• Campaigning for or against any candidate, party, office-bearer, slate, motion or ballot measure.
• Political advocacy, lobbying or promotion of a political party, ideology or policy position.
• Political fundraising, membership drives or political events.

5.5 Commercial Use

Any use that promotes a product, service or business, or that generates direct or indirect revenue.

5.6 Font Software

The font files and related data supplied by Akuru Type or otherwise lawfully made available under the applicable license.

Organisational Use and Political Use are not Personal Use, even when unpaid, voluntary, non-profit or generating no revenue.

6. Statutory Exceptions

Nothing in this agreement is intended to restrict a use that applicable law permits without the rights holder's authorisation, including any applicable exceptions for persons with disabilities or certain educational, research or other permitted uses, where all statutory conditions are satisfied.

Downloading a font from Akuru Type does not automatically establish that a statutory exception applies to subsequent use of the Font Software.

Akuru Type does not treat Organisational Use, Political Use or Commercial Use as exempt merely because the activity is unpaid, voluntary or non-profit. Whether a statutory exception applies depends on the relevant law and the facts of the particular use.

A person relying on a statutory exception is responsible for ensuring that the legal conditions for that exception are satisfied. Nothing in this agreement removes any rights or exceptions that cannot lawfully be excluded.

7. Brand Names, Attribution and Font Integrity

7.1 Brand names and identification

The names “Akuru Type,” its logo and the names used to identify individual fonts may be subject to intellectual property rights held by Encreare Pvt Ltd, Akuru Type or the relevant Contributor, as applicable.

This agreement does not represent that any such name or logo is a registered trademark unless registration has been confirmed. A font license does not, by itself, grant a separate right to use a brand name or logo as a trademark.

7.2 No misleading use

You may not use a font's name, the Akuru Type name or associated branding in a way that falsely suggests that another font, product or service is produced, approved, sponsored or endorsed by Akuru Type or the relevant Contributor.

7.3 Attribution and notices

You may not remove or alter copyright notices, designer credits or license information embedded in the Font Software.

You may not falsely present the Font Software, or any part of it, as your own original work.

7.4 Font integrity

You may not distort, mutilate or modify a font in a manner that infringes applicable rights or unlawfully harms the reputation of its designer.

This provision operates alongside the restrictions on modification, adaptation and derivative works in the applicable license and these Terms and Conditions.

8. Unauthorised Use and Enforcement

8.1 Unauthorised use

An individual or entity that uses, reproduces, distributes or embeds a font outside the permissions granted by the applicable license may be in breach of this agreement.

This includes using a Free for Personal Use font for Organisational Use, Political Use or Commercial Use without the required Commercial License or other valid authorisation.

Obtaining a font through a third-party platform, designer, template or design pack does not by itself establish that the use is authorised.

8.2 Liquidated damages

Subject to applicable law and the enforceability of this provision, Akuru Type may seek liquidated damages of MVR 50,000 (fifty thousand Maldivian Rufiyaa) for each established breach occurring on or after 1 November 2026.

For breaches occurring before 1 November 2026, the previously applicable amount of MVR 20,000 (twenty thousand Maldivian Rufiyaa) applies, subject to the terms in force at the time and applicable law.

Akuru Type may assess each unauthorised use, reproduction, distribution or embedding separately where the facts and applicable law support treating it as a separate breach. The number of breaches and any amount recoverable remain subject to applicable law and determination by a competent court where disputed.

The inclusion of a liquidated-damages amount does not guarantee that the amount will be upheld or recovered in every circumstance.

8.3 Legal remedies

Unauthorised use may also infringe copyright or other intellectual property rights. Where authorised and legally entitled to do so, Akuru Type and/or the relevant rights holder may pursue available remedies under applicable law, which may include seeking an injunction, compensation for damages or other relief available through the courts.

Any fines or other sanctions are matters for the competent authorities or courts under applicable law. Contractual claims and statutory remedies are subject to the legal requirements applicable to each.

8.4 Legal and enforcement costs

Akuru Type may seek recovery of reasonable legal and enforcement costs where recoverable under the applicable agreement and law, including where awarded by a competent court.

8.5 Notice and opportunity to resolve

Where appropriate, Akuru Type may send written notice identifying the suspected unauthorised use and requesting that the recipient:

• Stop or remedy the unauthorised use;
• Provide evidence of the applicable license or authorisation; or
• Obtain the appropriate license where available and suitable.

Unless otherwise stated in the notice or required by law, the recipient will have seven (7) days from the notice to respond or remedy the matter.

A notice does not prevent Akuru Type or the relevant rights holder from seeking urgent relief where legally available.

8.6 Failure to comply

If the recipient does not respond or remedy the matter within the specified period, Akuru Type may pursue further action available under applicable law, including referring the matter to relevant authorities or initiating legal proceedings where authorised.

8.7 Reporting unauthorised use

Suspected unauthorised use may be reported to Akuru Type at [email protected].

9. Terms and Conditions

By downloading, purchasing, installing, embedding or using a free or premium font from Akuru Type, you agree to these Terms and Conditions and the applicable license provisions.

9.1 Scope

These Terms and Conditions govern the relationship between you and Akuru Type, a business name of Encreare Pvt Ltd, in relation to fonts and related services supplied by Akuru Type.

Any additional or conflicting terms supplied by you, including in a purchase order, do not bind Akuru Type unless expressly accepted in writing.

9.2 Entire agreement and acceptance

Unless expressly identified as binding, quotations and price information may be changed before acceptance.

Oral agreements require written confirmation from Akuru Type. A purchase agreement becomes effective when accepted by Akuru Type in writing, such as through an order confirmation, or when the order is fulfilled, such as by delivery or download, as applicable.

Akuru Type may correct genuine errors in offers, invoices and communications, subject to applicable law and any binding agreement already in effect.

9.3 Assignment and transfer

Unless expressly agreed otherwise in writing, you may not assign, sublicense or transfer your license rights or obligations to a third party.

A change of control or other transaction may constitute an assignment where permitted by applicable law and the relevant agreement.

9.4 Non-transferability and reproduction

A. Non-transferable license

A license is non-transferable unless the applicable license or a written agreement expressly permits transfer. You may not sell, lease, sublicense, lend, rent, distribute or otherwise transfer the license or its rights to a third party without authorisation.

B. Restrictions on the Font Software

Except where expressly permitted by the applicable license or applicable law, you may not reproduce, decompile, reverse engineer, disassemble, adapt, modify, translate or create derivative works from the Font Software, or otherwise alter it.

C. No resale or sharing

You may not sell, resell, share, distribute or otherwise make the Font Software available to a third party as a reusable font file unless expressly authorised.

This includes giving a font downloaded for Personal Use to an Organisation or to a person intending to use it for Political Use or Commercial Use without the required permission.

D. Embedded fonts

Where a license permits embedding the Font Software in electronic documents, websites or applications, embedding is limited to the scope, project, product, domain, application or other deployment covered by the applicable license.

The Font Software must not be made extractable or reusable by recipients except where the applicable license expressly permits it.

E. Breach

A material breach of these provisions may result in suspension or termination of the license, subject to the agreement and applicable law. Akuru Type may pursue remedies available to it and, where authorised, to the relevant Contributors or rights holders.

9.5 Delivery

Unless otherwise agreed, fonts are delivered electronically through the Akuru Type website or another delivery method approved by Akuru Type.

Unless stated otherwise in writing, prices are in Maldivian Rufiyaa (MVR). Applicable taxes imposed by the Maldives Inland Revenue Authority or other competent authority will be charged where required by law.

9.6 Payment

Premium fonts downloaded through the website must be paid for according to the payment instructions provided at checkout or during the purchase process.

Custom fonts are payable within fifteen (15) days of the invoice date unless otherwise agreed in writing.

Overdue amounts may incur interest at 1.5% per month or the maximum rate permitted by applicable law, whichever is lower, subject to applicable law.

9.7 Warranty and liability

Unless otherwise expressly stated in writing or required by law, fonts and related services are provided on an “as is” and “as available” basis.

To the extent permitted by law, Akuru Type does not provide implied warranties that cannot lawfully be excluded, including warranties of fitness for a particular purpose or uninterrupted availability.

Nothing in this agreement excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

9.8 Partial invalidity

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

The affected provision will be interpreted or limited, where legally permissible, to best achieve its lawful purpose.

9.9 Termination, expiry and reinstatement

If a license expires or is terminated, use beyond the surviving permissions is no longer authorised.

Akuru Type may, at its discretion, agree to reinstate an expired or terminated license. Where applicable, it may charge a one-time reinstatement fee of 20% of the last annual license fee. This fee does not apply to fonts sold for a one-time fee.

Any reinstatement is subject to written confirmation and any conditions agreed between the parties.

9.10 Changes to these terms

Akuru Type may update these Terms and Conditions from time to time. The version applicable to a particular use will be determined by the applicable agreement, the effective date of the relevant terms and applicable law.

The revised terms are intended to apply to downloads and uses occurring on or after 1 November 2026, subject to applicable law and any existing binding agreements. Nothing in this provision retrospectively changes a party's rights or obligations where such a change is not legally permitted.

9.11 Governing law and jurisdiction

This agreement is governed by the laws of the Republic of Maldives, including the Copyright and Related Rights Act (Law No. 23/2010), as amended, where applicable.

Subject to mandatory legal requirements, disputes arising from this agreement or the use of a font may be brought before the competent courts of the Maldives. This provision does not prevent the enforcement of applicable intellectual property rights in another jurisdiction where legally available.

9.12 Language

This agreement may be published in English and Dhivehi. If both versions are published, the prevailing version should be expressly identified as [English / Dhivehi]. The selected version is subject to applicable law.

These terms are intended to describe Akuru Type's licensing policy and the permissions offered to users. They are not a substitute for legal advice.
