Prior to purchase or font utilization, it is essential to review the Akuru Type End User License Agreement for the legal framework. Our licenses fall under three primary categories and reflect the terms and conditions of the use of this e-commerce platform.

Desktop Licensing

The "Desktop License" allows Font Software installation on desktops, laptops, or workstations. It covers the utilization of Font Software for creating printed publications for commercial distribution like newspapers, magazines, etc. Additionally, it permits the creation of static graphics for screens, including those for social media, and supports broad corporate use.

Web-font License

To utilize our fonts on a website, intranet, or web-based app, you need a "Web-font License." Explore two options for licensing web-fonts: the self-hosted or hosted solution.

Web-font Self-hosting

Opting for a Web-font Self-hosting License involves hosting fonts on the Licensee's web servers. The Font Software should be securely stored and served from the same devices and location as other software and assets associated with the licensed domain names. Licensees must take precautions to prevent unauthorized downloads, and the use of third-party font hosting services is strictly prohibited.

Web-font Hosted

Selecting the Web-font Hosted License involves obtaining it through one of Akuru Type ' web-font-hosting partners. These hosting partners are responsible for storing and servicing the fonts, ensuring browser optimization, and safeguarding the fonts through server referrals, caching, pattern matching, and obfuscation of font files.

Application License

The "Application License" is an additional permission allowing the licensee to embed the font in applications, encompassing the use of Font Software for styling live text in various applications. This includes, but is not limited to, software applications, mobile applications designed for native operation on mobile operating systems, and console games. Fonts must be in a secure digital format that only permits users to view the font. Users are strictly prohibited from performing any download, editing, altering, extracting, or other modification of the font under any circumstances.

Free Font Use

Free fonts on our platform can be freely used for commercial purposes without modification or alteration to the fonts, unless otherwise specified in the font usage license. This applies to individuals, businesses, and organizations utilizing the fonts listed in our marketplace.

Premium Font Use

The premium fonts on our platform come with a license that grants commercial use for an individual or business, allowing for the creation of brand lettermarks or logos. However, these fonts are strictly non-transferable and cannot be resold, reproduced, or modified for distribution to any third party.

Terms and Conditions

By acquiring (downloading) our premium and free fonts, you agree to the following terms and conditions:

Scope

These Terms and Conditions exclusively govern the present and future business relationships between “Akuru Type” (registered under Encreare Pvt Ltd with the business name Akuru Type) and you, the customer. Any additional or conflicting terms issued by you, including those on a purchase order, are not binding on Akuru Type unless expressly agreed to in writing.

Entire Agreement

Quotations or price information provided by Akuru Type are non-binding and subject to change without notice unless expressly designated as binding. Oral agreements require written confirmation from Akuru Type. A contract becomes valid upon written acceptance by Akuru Type (e.g., order confirmation) or upon order fulfillment (e.g., delivery, download, or software connection by you). Akuru Type reserves the right to rectify errors in offers, invoices, and communications. Cooperation between you and Akuru Type is essential for the full implementation of the agreement.

Assignment

Unless expressly outlined in a written agreement between you and Akuru Type, your obligations may not be sublicensed or assigned to any third party (with a change in your control constituting an assignment). These Terms and Conditions are binding on successors and assigns.

Non-Transferability and Reproduction:

(a) Non-Transferable: This License is non-transferable. You may not sell, lease, sublicense, loan, rent, distribute, or otherwise transfer this License or any rights granted hereunder to any third party.

(b) No Reproduction: You are strictly prohibited from reproducing the Font Software, in whole or in part, in any format or by any means, including but not limited to, decompiling, reverse engineering, disassembling, modifying, adapting, translating, creating derivative works from, or otherwise altering the Font Software.

(c) No Resale: You are strictly prohibited from selling, reselling, distributing, or otherwise making the Font Software available to any third party, whether for profit or not.

(d) Embedded Fonts: If this License permits embedding of the Font Software in electronic documents or applications, such embedding shall be limited to the specific project or product for which the License was purchased and shall not be transferable or usable in any other project or product.

(e) Breach of this Clause: Any breach of this Clause shall constitute a material breach of this License and may result in immediate termination of the License and any rights granted hereunder. The Akuru Type reserves the right on behalf of the contributors to pursue any and all legal and equitable remedies available to it in the event of any breach of this Clause.

Delivery

In accordance with the law, Akuru Type's standard delivery terms are done via the e-commerce platform website. Prices, unless specified in writing, are quoted in Maldivian Rufiyaa (MVR) and exclude all taxes imposed by the Maldives Inland Revenue Authority, payable by you.

Payment

For premium category font downloads via the e-commerce platform, payment is immediate with relevant slips uploaded. For custom fonts, payment terms are net fifteen (15) days from the invoice date unless otherwise agreed in writing. Overdue payments incur interest at the lower of 1.5% per month or the maximum permissible under applicable law.

Warranty

Unless stated in writing or required by law, goods and services are provided "as is" without any representation or warranty, including non-infringement or fitness for a specific purpose.

Partial Nullity

Unenforceability or invalidity of any provision does not render the Terms and Conditions as a whole unenforceable or invalid. In such cases, the provision will be interpreted to best achieve its objectives within legal limits.

Termination or Expiry

If a license agreement expires or is terminated, and reinstatement is requested, Akuru Type may, at its discretion, agree, and may charge a one-time fee of 20% of the last annual term fee. If it's a one-time font fee as specified by the contributor, this clause does not bind the requirement for a penalized fee.

Governing Law and Jurisdiction

This agreement is subject to the laws of The Republic of Maldives, disregarding any applicable conflict of laws provisions.
